近日,有網(wǎng)友發(fā)帖稱,大學(xué)生出門(mén)旅游,乘坐高鐵時(shí)被行李架上26寸行李箱砸到頭,要求行李箱主人賠付醫(yī)藥費(fèi)無(wú)果。
A passenger was struck by a falling suitcase from an overhead rack on a high-speed train in China, triggering a compensation dispute and raising concerns over onboard luggage safety.
據(jù)九派新聞,當(dāng)事人章女士介紹,4月19日中午12:40左右,她與同行伙伴乘坐D3069列車(chē)從南京南站出發(fā),乘車(chē)時(shí)有一名男子在其頭頂?shù)男欣罴苌戏胖昧艘粋€(gè)26寸行李箱,發(fā)車(chē)后箱子掉下來(lái)砸到了她。

章女士稱,當(dāng)時(shí)只是砸腫了,她和行李箱主人被帶到餐車(chē),被要求簽一份協(xié)調(diào)書(shū),大致意思是要求行李箱主人賠償全部醫(yī)藥費(fèi)。
The incident occurred around 12:40 pm on April 19 aboard train D3069 departing from Nanjing South Railway Station. Zhang said a 26-inch suitcase stored in the overhead rack above her seat fell shortly after departure, striking her on the head and leaving her with swelling. Railway staff later brought both parties to the dining car and asked them to sign a mediation agreement covering medical expenses.
據(jù)章女士稱,就醫(yī)過(guò)程中,行李箱主人杜先生支付了急診的20元掛號(hào)費(fèi),和CT檢查費(fèi)210元。醫(yī)院檢查結(jié)果出來(lái)后,杜先生提出賠她100元,此事就算了結(jié)。章女士沒(méi)有同意,其認(rèn)為此事對(duì)她行程造成了影響。“我要求他賠償我600元交通費(fèi)和藥費(fèi)。但對(duì)方不同意。”
Medical records showed Zhang underwent a CT scan, with the suitcase owner, surnamed Du, covering the 20-yuan registration fee and 210-yuan examination cost. He later offered an additional 100 yuan as settlement, which Zhang rejected, seeking 600 yuan for transportation and medication expenses instead.
4月20日8點(diǎn)18分,她撥打了12306的投訴電話,10點(diǎn)左右列車(chē)長(zhǎng)聯(lián)系她,“說(shuō)可以把票退我,這400元是個(gè)人補(bǔ)償,補(bǔ)償后事情就處理結(jié)束了”。
22日,她告訴記者,已收到了這400元“補(bǔ)償”。此外,還收到了19日她在合肥南站退掉被扣20%手續(xù)費(fèi)的原票后,重新上車(chē)補(bǔ)票的費(fèi)用。行李箱主人方面,“除了檢查(費(fèi)),連句道歉都沒(méi)有,藥也沒(méi)有買(mǎi)給我,我覺(jué)得他的做法非常不合理。”章女士說(shuō)。
After filing a complaint through China Railway's 12306 hotline the following day, Zhang received 400 yuan in compensation, along with reimbursement for a ticket rebooking fee.
箱子主人稱超過(guò)應(yīng)承擔(dān)責(zé)任范圍
杜先生告訴記者,事發(fā)后他主動(dòng)帶章女士去醫(yī)院檢查,并承擔(dān)了檢查費(fèi)與來(lái)回打車(chē)費(fèi)用。其認(rèn)為,600元這一數(shù)額,“已經(jīng)超過(guò)我認(rèn)為自己應(yīng)承擔(dān)責(zé)任的范圍”。他認(rèn)為,自己沒(méi)有過(guò)錯(cuò)。
Du said he had fulfilled what he considered a reasonable obligation by accompanying Zhang to the hospital, covering her medical costs and paying for taxi fares. He argued that her compensation demand exceeded what he believed he should reasonably bear.
“是我的箱子,但不是我在放箱子的時(shí)候掉下來(lái)砸到她,而是開(kāi)車(chē)之后箱子自己掉下來(lái)砸到了她。從我放上去到箱子掉下來(lái),中間隔了至少十幾分鐘,這么多人放箱子,碰來(lái)碰去的,我怎么知道到底是什么情況。”
He also disputed direct responsibility, saying the suitcase had remained in place for more than 10 minutes before falling and may have been disturbed by other passengers placing luggage nearby.
杜先生稱,“我主動(dòng)帶她去醫(yī)院檢查,把最重要、最緊急的生命安全問(wèn)題解決了。”對(duì)于章女士索要的600元賠償,杜先生表示:“我愿意給她一點(diǎn)精神損失或其他賠償,但她張口就要這么多,我肯定接受不了。”
關(guān)于雙方在列車(chē)人員面前簽的協(xié)調(diào)書(shū),杜先生提到,當(dāng)時(shí)協(xié)調(diào)書(shū)上寫(xiě)“乘客擺放不當(dāng)”,他對(duì)此并不認(rèn)同,但因?yàn)楹竺嬗惺拢MM快解決這件事,于是簽了字。

12306:高鐵上方行李架只能存放小型行李
4月24日,經(jīng)視直播記者咨詢12306客服,工作人員表示高鐵上方行李架只能存放小型行李,如雙肩包、提包、20寸行李箱等,26寸行李箱屬于大件行李,建議存放在大件行李存放處,也就是車(chē)廂連接處。工作人員還表示,因?yàn)楦哞F線路問(wèn)題可能發(fā)生搖晃,大件行李可能會(huì)掉落,所以乘客如果發(fā)現(xiàn)有大件行李被放置在上方行李架,也可以聯(lián)系列車(chē)員進(jìn)行調(diào)整。
China Railway's customer service said overhead racks on high-speed trains are intended for small items such as backpacks, handbags and suitcases up to 20 inches. Larger luggage, including 26-inch cases, should be stored in designated areas near carriage connections, warning that train movement may cause improperly stored items to shift or fall.
湖北以誠(chéng)律師事務(wù)所律師蔡巍表示,此次事件責(zé)任劃分,要結(jié)合現(xiàn)場(chǎng)具體情況判定。按照高鐵行李存放標(biāo)準(zhǔn),行李架更適合放置小型行李箱,26寸箱體偏大、擺放擁擠。
責(zé)任關(guān)鍵在于行李箱如何被放上行李架:若是乘客自行強(qiáng)行放置不合規(guī)行李,列車(chē)工作人員未及時(shí)制止,則乘客承擔(dān)主要責(zé)任,鐵路方承擔(dān)未盡到管理義務(wù)的次要補(bǔ)充責(zé)任;若鐵路工作人員默許甚至協(xié)助放置,則鐵路方需承擔(dān)主要責(zé)任。
Legal experts said liability in such cases depends on how the luggage was stored and whether railway staff intervened. A passenger who independently placed oversized baggage in an unsuitable space may bear primary responsibility, while railway operators could share liability if they failed to enforce storage rules or assisted with the placement.
若行李符合尺寸、擺放穩(wěn)妥,非人為擺放問(wèn)題,因列車(chē)運(yùn)行顛簸等特殊因素意外掉落,屬于意外事件,行李箱主人仍需承擔(dān)相應(yīng)侵權(quán)賠償責(zé)任。警方認(rèn)定本案屬于民事糾紛無(wú)誤,當(dāng)事人若想進(jìn)一步維權(quán)、追索完整賠償,最終可通過(guò)訴訟途徑解決。
