近日,一則“河南商家驅車1600公里赴山東尋找‘僅退款’買家”的消息,引發社會關注。
A determined Chinese merchant drove 1,600 kilometers from Henan to Shandong province to hunt down a customer who falsely claimed "moldy goods" to receive a full refund without returning the product — a pursuit that ended with the buyer's administrative detention, police in Shandong confirmed on Friday.

5月8日,海報新聞記者采訪獲悉,涉案人員袁某某因虛構事實騙取退款,已被行政拘留。
據了解,山東德州慶云縣一村民袁某某在河南商家程某經營的電商店鋪購買榴蓮肉,收貨后,袁某某虛構“商品發霉”,向平臺申請“僅退款”,最終拿到全額退款。
The customer, a villager surnamed Yuan in Qingyun county, Shandong province, had bought frozen durian pulp from Henan-based merchant Cheng. After receiving the order, Yuan falsely alleged the durian was moldy and exploited the "refund only" option to pocket a full refund while keeping the item.
5月6日,商家向當地警方報警并提供證據。5月7日,慶云縣公安局徐園子派出所立案并開展調查取證和處置工作。

經查,袁某某的行為已構成詐騙,警方依法對其行政拘留。相關方面同步組織雙方開展調解工作,督促袁某某對商家損失進行賠償,切實維護經營者合法權益。

商家驅車1600公里找買家,翻遍垃圾桶找證據。
另據極目新聞證實,記者同日從慶云縣徐園子鄉政府工作人員、徐園子派出所民警處,均得到了“僅退款買家已被行拘”的答復。
Cheng filed a police complaint in Shandong on Wednesday. The following day, police opened a case and found that Yuan had fabricated evidence and committed fraud. Yuan was administratively detained and Cheng was provided compensation, which was mediated by authorities. The detention was confirmed by the local police station and town government staff.
新京報消息,5月7日,河南濮陽一銷售冷凍榴蓮果肉商家稱遭山東德州一買家惡意“僅退款”。商家稱于4月26日發貨,28日買家稱榴蓮發霉,申請“僅退款”。商家查看發貨視頻及買家提供的圖片后,表示買家圖片中的霉變榴蓮非發貨商品。
商家前后花費5000余元,兩次驅車行駛1600公里往返買家所在地溝通。商家在買家住處附近垃圾桶中找到榴蓮包裝袋,未找到榴蓮,買家稱霉變榴蓮已分開丟棄。
Cheng had reviewed his own shipping video alongside the buyer's photos and concluded that the moldy durian was not the one he had sent. Undeterred, he made two 1,600-km round trips — spending over 5,000 yuan — to confront Yuan in person. He even rummaged through trash bins near Yuan's home, finding nothing but the empty packaging. The buyer later claimed the alleged moldy fruit had already been thrown away separately.
律師解讀
河南澤槿律師事務所主任律師付建稱,買家惡意“僅退款”的行為構成違約行為,需要承擔違約損失,包括商家所需要的維權成本。另外,即使金額沒有達到犯罪標準,買家也需要承擔行政責任。
Fu Jian, a lawyer based in Henan, commented that malicious "refund-only" behavior constitutes a breach of contract, and the buyer must cover the merchant's costs — including travel expenses. Even if the amount involved is small, administrative penalties still apply, he added.
付建建議,針對惡意退款行為,商家可通過提供打包發貨的視頻、圖片、物流記錄、買方提供的虛假圖片等向平臺反饋要求撤銷并追回退款,或者可向公安部門報案要求立案。
Merchants seeking to challenge fraudulent refund claims can submit packing videos, shipping records, and photos of the actual goods to the e-commerce platform or file a complaint with the police, Fu advised.
