男子猛推峨眉山猴險致其墜崖！多部門介入調查

近日，“男子推峨眉山崖邊進食猴子，險致其墜崖”的視頻在網絡上傳播，引發熱議。

A video showing a man pushing a monkey off a cliff edge at Mount Emei in Sichuan province has gone viral on Chinese social media, sparking widespread backlash.

視頻顯示，峨眉山景區雷洞坪附近一處步行道上，一只猴子在山崖邊安靜進食時，一男子悄悄靠近，突然伸手將猴子往懸崖外猛推。所幸猴子反應及時抓住了護欄，才未墜落懸崖。事后，該男子嬉笑著跑開。

The footage, filmed on a walking trail near Leidongping in the Mount Emei Scenic Area, shows a monkey quietly eating near the edge of a cliff when a man approaches from behind and suddenly pushes the animal. The monkey manages to grab onto a railing and avoids falling. The man then laughs and runs away.

視頻發布者稱，該男子的行為“把猴嚇一跳，把我也嚇一跳”。

5月6日晚，封面新聞記者從峨眉山景區管委會獲悉，該男子目前已經離開景區，景區公安、林業等多個部門正介入調查。

On Wednesday evening, the Mount Emei Scenic Area management authority told Cover News that the man had already left the site and that local police and forestry authorities had launched an investigation.

網友：猴子的命也是命，不能漠視生命

大量網友針對此事留言，認為該男子行為不妥。

有人說：“我很少站在猴子這邊，但這次我站猴子。”“這不是開玩笑，而是漠視生命。”

也有人追問事件調查進展：“猴子的命也是命，傷害國家二級保護動物，要有個說法。”

律師：若造成猴子死亡，屬違法行為

四川方策律師事務所郭剛律師告訴記者，依據《中華人民共和國野生動物保護法》第21條、第48條規定，該男子的行為完全是一種非理性之舉。

若造成猴子摔下懸崖死亡，則屬于殺害野生動物的違法行為，行政上可能被處一萬元以上、十萬元以下罰款；構成犯罪的，還可依法追究刑事責任。

Guo Gang, a lawyer with Sichuan Fangce Law Firm, said the man's behavior may have violated Articles 21 and 48 of China's Wildlife Protection Law.

He said that if the monkey had fallen to its death, the act could have constituted the illegal harming or killing of wildlife, potentially resulting in an administrative fine ranging from 10,000 to 100,000 yuan. In serious cases, criminal liability could also apply.

“但若猴子主動攻擊游客、危及游客人身安全，游客在此緊急情況下采取措施造成猴子損害的，依據《中華人民共和國野生動物保護法》第19條第三款的規定，游客不承擔法律責任。”郭剛說。

However, Guo added that under Article 19, paragraph 3 of the same law, a person would not bear legal responsibility if they harmed a wild animal while acting in self-defense during an emergency situation that posed a direct threat to personal safety.

據悉，峨眉山猴子為藏酋猴，俗稱“藏獼猴”“峨眉猴”“大青猴”，是國家二級保護野生動物。它們以多種植物的葉、芽、果、枝及竹筍為食，兼食昆蟲、蛙、鳥卵等動物性食物。

峨眉山景區自然分布約15群、500余只野生猴，既有一定靈性，又野性猶存。

長期以來，景區禁止游客投喂野生猴、招猴、逗猴、戲猴、撫摸野生猴，更嚴禁游客做出瞪視、追趕、驚嚇、吼叫、踢打等刺激或攻擊猴子的行為。
